Formålene med og retsgrundlaget for behandlingen af dine personoplysninger
Vi behandler dine personoplysninger til følgende formål:
Juridiske ydelser
Er du klient hos os eller potentiel klient, så behandler vi dine oplysninger for at kunne opfylde aftalen mellem os og yde juridisk rådgivning.
Vi kan, efter omstændighederne, behandle almindelige personoplysninger om dit navn, e-mailadresse, telefonnummer, privatadresse, stilling samt dit CPR-nummer. Vi kan ligeledes behandle særlige kategorier af personoplysninger, hvis dette er nødvendigt for at kunne yde den rigtige juridiske rådgivning. Det samme gør sig gældende vedrørende strafbare forhold.
Retsgrundlaget er databeskyttelsesforordningens artikel 6, stk. 1, litra b (kontrakt/aftale) samt vores legitime interesse til håndtering af henvendelser vedrørende potentiel rådgivning, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra f.
Er det nødvendigt at behandle særlige kategorier af personoplysninger og strafbare forhold, sker dette efter databeskyttelsesforordningens artikel 6, stk. 1, litra b og artikel 9, stk. 2, litra f (retskrav) for de særlige kategorier af personoplysninger samt databeskyttelseslovens § 8, stk. 3 og 4 for oplysningerne om strafbare forhold.
Vi behandler derudover personoplysninger efter hvidvaskloven. Dette gælder blandt andet identitetsoplysninger, CPR-nummer, pasnummer osv., alt efter hvilken form for legitimation, som vi har fået tilsendt.
Parter og modparter
Er du part, modpart og lignende i en sag, som Roesgaard Advokater behandler, så behandler vi dine oplysninger for at kunne bistå vores klient.
Hvilke oplysninger vi behandler varerier fra sag til sag, men det kan f.eks. være almindelige personoplysninger som navn, e-mailadresse, telefonnummer, adresse, stilling og relation til sagen.
Retsgrundlaget er vores legitime interesse i at bistå vores klient, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra f.
Når du søger job
Hvis du søger et uopfordret job ved Roesgaard Advokater, behandler vi de oplysninger, som du sender med formål at muligvis kunne tilbyde dig ansættelse. De oplysninger vi behandler afhænger af, hvad du sender, men det kan f.eks. være navn, adresse og e-mail.
Retsgrundlaget for behandlingen er vores legitime interesse i at tilbyde dig ansættelse, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra f.
Markedsføringsaktiviteter (kurser, guides osv.)
Vi indsamler oplysninger om dig for at tilmelde dig kurser eller tilsende dig guides.
Hvis du tilmelder dig et af vores kurser, vores undervisning eller øvrige arrangementer, så behandler vi oplysninger om dit navn, stilling, virksomhed, e-mailadresse og telefonnummer. Retsgrundlaget er databeskyttelsesforordningens artikel 6, stk. 1, litra b (kontrakt/aftale).
Hvis du ønsker at få tilsendt guides, så behandler vi oplysninger om navn, e-mailadresse og virksomhed. Retsgrundlaget er dit samtykke, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra a.
Modtagere eller kategorier af modtagere
Vi videregiver alene dine personoplysninger til eksterne aktører, herunder f.eks. offentlige myndigheder, modparter, kontraktsparter, domstolene mv., hvis dette er nødvendigt for, at vi kan opfylde vores aftale med dig, eller hvis dette kræves ifølge lovgivningen.
Vi bruger databehandlere (it-leverandører, elektronisk fakturering mv.) for at kunne levere den bedst mulige ydelse til vores kunder.
Internt hos Roesgaard Advokater P/S er det i udgangspunktet kun de medarbejdere, der er tilknyttet din sag, der har adgang til de oplysninger, der ligger på sagen.
Overførsel til modtagere i tredjelande, herunder internationale organisationer
Roesgaard Advokater kan overføre dine personoplysninger til lande uden for EU/EØS (tredjelande). Dette kan være i forbindelse med vores brug af databehandlere i tredjelande. Som et klart udgangspunkt sker overførslerne efter EU-Kommissionens standardkontraktbestemmelser eller ved certificerede virksomheder i USA efter EU-U.S. Data Privacy Framework.
Opbevaring af dine personoplysninger
Vi sørger for løbende at slette persondata, der ikke længere er nødvendig eller relevant for det formål, som oplysningerne blev indsamlet til.
Sagsrelaterede personoplysninger opbevarer vi som udgangspunkt i op til ti år. Oplysninger behandlet efter hvidvaskloven slettes fem år efter kundeforholdets afslutning. Dokumentation for dit markedsføringssamtykke opbevares i to år. Personoplysninger, der indgår i bogføringsmateriale, opbevares i fem år fra regnskabsårets udløb.
Retten til at trække samtykke tilbage
Du har til enhver tid ret til at trække dit samtykke tilbage. Dette kan du gøre ved at kontakte os på de kontaktoplysninger, der fremgår ovenfor i punkt 1.
Hvis du vælger at trække dit samtykke tilbage, påvirker det ikke lovligheden af vores behandling af dine personoplysninger på baggrund af dit tidligere meddelte samtykke og op til tidspunktet for tilbagetrækningen. Hvis du tilbagetrækker dit samtykke, har det derfor først virkning fra dette tidspunkt.
Dine rettigheder
Du har efter databeskyttelsesforordningen en række rettigheder i forhold til vores behandling af oplysninger om dig.

Ret til at se oplysninger (indsigtsret)
Du har ret til at få indsigt i de oplysninger, som vi behandler om dig, samt en række yderligere oplysninger.
Ret til berigtigelse (rettelse)
Du har ret til at få urigtige oplysninger om dig selv rettet.
Ret til sletning
I særlige tilfælde har du ret til at få slettet oplysninger om dig, inden tidspunktet for vores almindelige generelle sletning indtræffer.
Ret til begrænsning af behandling
Du har i visse tilfælde ret til at få behandlingen af dine personoplysninger begrænset. Hvis du har ret til at få begrænset behandlingen, må vi fremover kun behandle oplysningerne – bortset fra opbevaring – med dit samtykke, eller med henblik på at retskrav kan fastlægges, gøres gældende eller forsvares, eller for at beskytte en person eller vigtige samfundsinteresser.
Ret til indsigelse
Du har i visse tilfælde ret til at gøre indsigelse mod vores eller lovlige behandling af dine personoplysninger. Du kan også gøre indsigelse mod behandling af dine oplysninger til direkte markedsføring.
Ret til at transmittere oplysninger (dataportabilitet)
Du har i visse tilfælde ret til at modtage dine personoplysninger i et struktureret, almindeligt anvendt og maskinlæsbart format samt at få overført disse personoplysninger fra én dataansvarlig til en anden uden hindring.

The purposes and legal basis of the processing of your personal data
We process your personal data for the following purposes:
Legal services
If you are one of our clients or a potential client, we process your data to meet the terms of our agreement and provide legal advice.
We may, in the circumstances, process general personal data about your name, email address, phone number, home address, occupation and your CPR no. In addition, we may process special categories of personal data if necessary to provide the right legal advice. The same applies to criminal offences.
The legal basis is the General Data Protection Regulation, article 6, subsection 1, schedule b (contract/agreement) and our legitimate interest in handling requests regarding potential advice, cf. the General Data Protection Regulation, article 6, subsection 1, schedule f.
If it is necessary to process special categories of personal data and criminal offences, this is done according to the General Data Protection Regulation, article 6, subsection 1, schedule b and article 9, subsection 2, schedule f (legal right) regarding the special categories of personal data and the General Data Protection Regulation, section 8, subsection 3 and 4 regarding information about criminal offences.
We also process personal data according to Danish Anti-Money Laundering Act. This e.g. includes identity data, CPR no., passport no. etc. depending on the identification we have received.
Parties and counterparties
If you are a party, counterparty that Roesgaard Advokater processes, we process your data to assist our client.
Which data we process varies from case to case but may e.g. be general personal data such as name, email address, phone number, address, occupation and connection to the case.
The legal basis is our legitimate interest in assisting our client, cf. the General Data Protection Regulation, article 6, subsection 1, schedule f.
When you apply for a job
If you apply for an unsolicited job at Roesgaard Advokater, we process the data that you send with the purpose of possibly being able to offer you employment. The data we process depends on what you send but this may be name, address and email.
The legal basis of the processing is our legitimate interest in offering you employment, cf. the General Data Protection Regulation, article 6, subsection 1, schedule f.
Marketing activities (courses, guides etc.)
We collect data about you to sign you up for courses or send you guides.
If you sign up for one of our courses, our classes or other arrangements, we process data about your name, occupation, company, email address and phone number. The legal basis is the General Data Protection Regulation, article 6, subsection 1, schedule b (contract/agreement).
If you wish to be sent guides, we process data about name, email address and company. The legal basis is your consent, cf. the Data Protection Regulation article 6, subsection 1, schedule a.
Recipients or categories of recipients
We only disclose your personal data to external participants, including e.g. public authorities, counter parties, contract parties, courts etc. when necessary in order to meet the terms of our agreement or if this is required by law.
We use data processors (IT suppliers, electronic invoicing etc.) to provide the best service to our customers.
Internally at Roesgaard Advokater P/S, it is basically only the employees connected to your case that have access to the data of the case.
Transfer to recipients in third countries, including international organisations
Roesgaard Advokater may transfer personal data to countries outside the EU/EØs (third countries). This may be in connection with our use of data processors in third countries. As a clear starting point, the transfers are carried out according to the European Commission’s standard agreement provisions or certified companies in the USA according to the EU-U.S. Data Privacy Framework.
Storage of your personal data
We regularly delete personal data that is no longer necessary or relevant for the purpose for which the data was collected.
We store sales related personal data in principle for up to ten years. Data processed according to the Danish Anti-Money Laundering Act is deleted five years after the customer relationships have ended. The documentation of your marketing consent is stored for two years. The personal data included in the accounting material is stored for five years from the end of the financial year.
The right to withdraw your consent
You have at any time the right to withdraw your consent. You can do this by using our contact information, see item 1 above.
If you decide to withdraw your consent, this does not affect the legality of our processing of your personal data based on your previously communicated consent and until the time of withdrawal. If you withdraw your consent, this is not effective before this time.
Your rights
According to the General Data Protection Regulation, you have some rights as regards out processing of your personal data.
If you want to make use of your rights, you have to contact us.
Right to access data (right of access)
You have the right to gain access to your personal data that we process and several other data.
Right to correction
You have the right to have your inaccurate personal data corrected.
Right to deletion
In special cases, you have the right to have your personal data deleted before the time of our general deletion.
Right to limitation of processing
In special cases, you have the right to have the processing of your personal data limited. If you have the right to have your processing limited, we are, in the future, only allowed to process data – except storage – with your consent, or for the purpose of determining, making valid or protecting a legal right or to protect a person or important social interests.
Right to object
In special cases, you have the right to object to our or legal processing of your personal data. You also have the right to object to our processing of your data for direct marketing.
Right to transfer data (data portability)
You have in special cases the right to receive your personal data in a structured, commonly used and machine-readable format and to have the personal data transferred from one data controller to another without hindrance.
